Backlog in Employment Visas for 3rd Preference Chinese, Indian and Filipino NationalsJan 17, 2005 The U.S. Department of State’s January 2005 visa bulletin reports that there is a backlog for the employment-based third preference category for nationals of China, India and the Philippines. This backlog applies to skilled workers and professionals. This means that individuals will need to check the priority dates on their approved labor certifications before filing for their immigrant visa petitions and adjustment of status applications together. Individuals who are unable to concurrently file can still have their employer file a separate I-140 petition. Adjustment applications cannot be filed until the applicant’s priority date is reached.
